Employer Webinar: COVID-19 and Your Workplace – Understanding the New Pandemic Employment Laws – June 4,2020

On the late afternoon of Friday May 29, 2020, the Ontario Government published an unnamed regulation (O. Reg. 228/20) (the “ESA COVID-19 Regulation”). The ESA COVID-19 Regulation brings about substantial retroactive changes to Ontario’s employment laws during the pandemic, including in regards to changes to hours of work, layoffs, and terminations. Perhaps most significantly, retroactive to March 1, 2020, employees who were placed on a temporarily layoff as a result of the pandemic are now automatically on an emergency leave instead. Accordingly, all employees who were nearing the end of the 13 week layoff period will no longer be automatically dismissed.
